After the failed organizing vote of Mercedes-Benz workers in Alabama, the United Auto Workers union is challenging the results and demanding a new election. The UAW claims that the German automaker fired four pro-union workers, pressured workers to attend anti-union meetings, and obstructed workers’ ability to advocate for the union.

The National Labor Relations Board (NLRB) confirmed that it received the UAW’s objections and will review the allegations of an unfair election. If substantial issues of fact are found, a hearing may be ordered. If the employer’s conduct is deemed to have affected the election, a new one could be ordered. The NLRB is also investigating unfair labor practice charges filed by the UAW against Mercedes-Benz.

Mercedes-Benz responded by stating that company officials followed NLRB guidelines and expressed hope that the UAW would respect the decision of Team Members. The automaker emphasized cooperation with the objection process and reiterated their commitment to following regulations.

The allegations against Mercedes-Benz include disciplining employees for discussing unionization, banning the distribution of union materials, surveilling employees, dismissing union supporters, and coercing employees to attend anti-union meetings.

The results of the Alabama vote dealt a blow to the UAW’s efforts to organize workers, especially after a successful drive at a Volkswagen plant in Tennessee. The organizing drive at Mercedes-Benz was expected to be more challenging due to the union’s history at the Volkswagen plant and less opposition from the automaker.
